Scotland has introduced new rental regulations that place clearer time limits on landlords and letting agents dealing with damp and mould in rented homes. The measures took effect on 6 October 2026 and add operational obligations for property owners and managers.
Under the rules, investigations into reports of damp and mould must be completed within 10 working days. Where an investigation identifies a substantial problem, remedial work must begin within five working days.
The changes raise the compliance stakes for landlords, agents and portfolio operators, particularly those managing older housing stock or properties with recurring moisture-related defects. Owners will need processes that can document reports, inspections and the start of repair work within the required periods.
The regulations also address tenancy succession and strengthen penalties connected to wrongful termination. Investors and residential landlords should review tenancy-management procedures alongside maintenance arrangements to ensure their practices reflect the new requirements.
